WASHINGTON — Senate Minority Leader Mitch McConnell intends to file a brief supporting a lawsuit challenging the constitutionality of some parts of the new health care reform law.

McConnell, R-Ky., has been looking for other senators to join in the brief and may file it as early as next week in U.S. District Court in Pensacola. The suit was brought by Florida Attorney General Bill McCollum on behalf of his and 19 other states.

Congressional Republicans, led by McConnell and others, still want to pursue repealing the law. But given their remote chance of success, the lawsuit is a second front in the battle against President Barack Obama’s signature domestic initiative.

In a letter to colleagues Tuesday, McConnell said the vote in the Nov. 2 midterm election showed that Americans “oppose a 2,700-page health care law that dramatically increases spending and expands the reach of the federal government into their health care decisions.”
